Asylum applicant is a person being a subject of the application for international protection, as defined in Article 2(g) of Council Directive 2004/83/EC of 29 April 2004 on minimum standards for the qualification and status of third-country national or stateless persons as refugees or as persons who otherwise need international protection and content of the protection granted. According to Article 2(g) 'application for international protection' means a request made by a third country national or a stateless person for protection from a Member State, who can be understood to seek refugee status or subsidiary protection status, and who does not explicitly request another kind of protection, outside the scope of this Directive, that can be applied for separately. Asylum applicant is understood to request protection under either Article 1of the Convention relation to the Status of Refugee of 28July 1951, as amended by the New-York Protocol of 31 January 1967 or within the remit of the United Nations Convention Against Torture and other forms of cruel or inhuman treatment (UNCAT) or the European Convention on Human Rights or other relevant instruments of protection.
